Pace of investigation into deadly Ohio fire frustrates firefighters

CLEVELAND — The investigation into the deadliest crime in the city's history has been completed since January, police said, but no charges have been filed.

The slow pace of the investigation into who set fire to a house on East 87th Street more than three years ago has outraged relatives of the nine people — eight of them children — who died in the blaze.

"We have been kept in the dark," said Don Taylor, a Cleveland firefighter whose godson, Earnest Tate Jr., was killed in the fire. "I have always inquired."

Arson cases are typically handled by the Cuyahoga County prosecutor's office, but federal prosecutors took over the case in the spring, according to a memo written by Cleveland's public safety director.

On Tuesday, a woman who survived the fire, Capritta Bell, said she had received a subpoena to testify before the federal grand jury.

Bell, who spent three weeks in a burn unit recovering after the fire, declined to comment further.

Cuyahoga County Prosecutor Bill Mason said his office still might file charges. The delay, he said, is because his office is continuing to investigate the crime.

Mason's explanation contradicts that of Deputy Police Chief Ed Tomba, who has helped supervise a task force including Cleveland police arson detectives and agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives.

The investigation was finished eight months ago and turned over to prosecutors, Tomba said.

Sources with detailed knowledge of the case say personal conflicts between investigators and Cuyahoga County prosecutors have gone on for years over investigative techniques.

In fact, sources said, federal agents and detectives have a suspect who is in a state prison for a drug conviction. That's one reason why prosecutors have had time to look over the investigation closely.

Mason said he won't comment on the investigation. But he stressed his office is committed to gaining a conviction for the nine people killed, and that's why the investigation has taken more than three years.

"It has been a long time and I want to see justice too," Mason said. "But before we take a case to the grand jury, we need to make sure we have the evidence to support it."

Shortly before 3 a.m. on May 21, 2005, someone broke into Medeia Carter's rented home and doused her living room with gasoline, lit a match and ran.

Despite the warning, Carter, 33, and the children, ages 7 to 15, died in upstairs' bedrooms of smoke inhalation, according to authorities.

Mason said the fire haunts him.

Mason said no determination has been made on who would prosecute.

"It's the largest mass murder in Cleveland in my lifetime," Mason said.

William Edwards, the acting federal prosecutor in Cleveland, declined to comment.

Using a public records request, The Plain Dealer found a note Safety Director Martin Flask wrote to Mayor Frank Jackson about the fire. In the May 15 memo, Flask said county and federal prosecutors met in April.

"The investigation is now in the hands of the federal prosecutor," Flask wrote.

He declined to comment Tuesday, other than to say that investigators are working hard.

But the pace has angered family members.

Rosalind Golden, whose 13-year-old grandson Miles Golden Cockfield died in the fire, sat on her front porch Tuesday and wondered why it took so long to reach the point where a grand jury is investigating.

"Those nine people were so mercilessly taken," she said.

COMPREHENSIVE FIRE AND ARSON INVESTIGATION: This Course is  36 hour journey from the initial concept of the combustion reaction to determining the origin and cause of a fire to final case preparation for civil or criminal trial, this class teaches the new investigator the fundamentals of the chemical reaction responsible for fire, a concise look at the wide array of fuels with an emphasis on the hydrocarbon-based fuels, the development of a proper fire scene inspection protocol using the Scientific Method as a roadmap, fire pattern evaluation and interpretation, the evidentiary opportunities presented in a fire scene, follow-up investigation, sources of information, and the offering of final analysis of the overall investigation. After completion of this class, the student will be prepared to confidently assume fire and arson investigations for his or her agency. The student will receive the class workbook which will serve as a valuable resource and free access to the Southeastern Fire and Arson Training Institute’s website which provides weekly updates concerning fire and arson issues across our country. A certificate of successful completion will be issued.  Cost: $225. Any agency willing to host this training will receive two slots free of charge.


FATAL FIRE INVESTIGATION
: The discovery of a body in a fire scene increases the obligations of an origin and cause examination. Immediately, the fire has become a potential crime scene that will eventually involve multiple disciplines as each accomplishes their individual role. A fatal fire is much more than placing the remains in a body bag. The investigator becomes the voice of the deceased whose voice has been silenced. Critical information and potential criminal and civil evidence lies in the debris and the fire investigator will likely be looked upon as the team leader in an attempt to recover this valuable information. Know your role in a fatal fire investigation. Whether from the fire service, law enforcement, medical examiners office, coroner, or prosecutors, the need to learn the finer points of an investigation involving deaths is critical. This two-day class (16 hours) discusses the pathology of death, critical legal constraints, evidence recognition and recovery, documentation of the death scene and much more. The participant receives the class workbook which will be a valuable resource to be used in the field. Remember, you only get one chance to process a fatal fire scene. Cost: $125

FIRE AND ARSON FOR THE INSURANCE INDUSTRY : The insurance industry is a major player, and often an indirect victim, in property crimes such as arson. Additionally, most all fires result in a claim and claims settlement provided by the company providing coverage. The public service investigator relies on the critical information that only the insurance company or adjustor has. Conversely, the insurance investigator or adjustor plays a vital role in the investigation of fires. It is important that both disciplines have a concise understanding of each role in fire and arson investigation. This class focuses on the needs of the insurance representative or adjustor and paints a clear picture of the requirements of fire and police investigators. This class should definitely enhance communication between both career paths. This two-day class can be offered at your location. Any company or agency willing to sponsor the training will receive two complimentary slots in the class. A student manual is issued as well as a certificate of successful completion. Cost: $150

THE FIRE INVESTIGATOR AS AN EXPERT WITNESS:
(Serves annual refresher for court qualification)

Often a fire investigator is barred from testifying in legal proceedings because his or her discipline-specific training is not current. Too many individuals who consider themselves a “certified fire investigator” neglect to refresh their training in order to stay abreast of the constantly changing methods and protocols of modern fire science. The process has changed over the years and it continues to change almost daily. Are you current? Could you qualify as an “expert witness” today? This class will cover the newest legal issues facing fire investigators as well as report on the latest laboratory testing in a continuing effort to eradicate the myths that continue to pop up on occasions. This is an 8-hour class that should keep the fire investigator “up to date” and current. Consider it “in-service training” to prevent being forbidden to testify only because your training is obsolete. Cost: $125. Manual and certificate issued.


FIREFIGHTER RECOGNITION OF THE CRIME OF ARSON -will deliver this two hour class to collective fire departments, shifts, or combined groups.   Highlights how the suppression crews can supplement the investigation as they perform their suppression operations. Focus will be placed on suppression techniques that minimize further damage to structure and potential evidence; evidence control; legal issues; incendiary indicators of arson; origin and cause responsibilities and more. Cost: $300 per event.

 Doug Ross began his career in law enforcement in 1975 as a uniformed patrolman for the Greenville, SC Police Department. While at the Greenville Police Department for 13 years he drew assignments in Vice and Narcotics, Detective Division, Part II Criminal Investigations, Training Officer and finally was named the departments first full-time arson investigator.

In 1988, Doug left the Greenville Police Department to begin work as a field agent for the SC Arson Control Team. In 1989 he was promoted to Lieutenant and supervised the Upper half of South Carolina. In 1991 the Arson Control Team transferred to the South Carolina Law Enforcement Division (SLED) - Retiring from SLED in 2006 to begin another exciting phase of his career and formed his company - FIREFUZZ ENTERPRISES .

ug is recognized as a Certified Fire Investigator by the International Association of Arson Investigators based in St. Louis, MO. There are less than 1000 IAAI Certified Fire Investigators in the world (mid-2006).

Doug is a member of the International Association of Arson Investigators where he has served as a member of the IAAI Training and Education Committee, the Test Question sub-committee for the IAAI Certified Fire Investigator Committee, and currently on the IAAI Annual Conference Speakers committee. In May 2006, he was a guest instructor at the International’s Annual Training Conference in Denver, Colorado
where he spoke of his struggles with the residual effects of a chemical exposure suffered during the investigation of a hardware store fire in September 2001.
In June 2006 he was a guest instructor at the Wisconsin Chapter of the International Association of Arson Investigators annual meeting in Stevens Point.

He is a member of the SC Law Enforcement Officers Association, The Carolina Fire Investigators Association, and the NC Chapter of the International Association of Arson Investigators. He formerly coordinated and delivered Arson Investigation training at the SC Criminal Justice Academy, the SC Fire Academy, the SC Chapter of IAAI and the Carolina Fire Investigators Association. He has also conducted training sessions for the National District Attorneys Association, The National Advocacy Center, The SC Legal Investigators Association, the Pinellas County, Florida Arson Co-Op and many fire and police agencies in South Carolina. He is an organizing committee member of the Spartanburg County, SC Fire Investigation Team and has taken the lead in training their participants since its inception in 2001. He recently ended his career that spanned 32 years as a certified law enforcement officer in South Carolina
. He has participated in the investigation of over 1600 fire scenes and has instructed over 2000 hours of arson-related training for both fire and police.

He currently writes a monthly article pertaining to issues concerning fire and arson investigation that can be viewed on this website. He also appears quarterly as a guest writer for the Carolina Fire-Rescue-EMS Journal, a quarterly publication for the fire service published in Charlotte, NC.

He is currently an adjunct instructor in the newly formed Fire Science Technology program at Greenville (SC) Technical College. He instructs fire investigation currently at the college.

Training ranges from half-days to a five days conducted in Greenville, SC or at your training facility.

Agencies/departments who wish to serve as a host agency will be given complimentary slots in the class.
Training topics include: 40 Hour Comprehensive Arson Investigation Skills, Fatal Fire Investigation, Understanding Fire Behavior, Motivations of the Arsonist, Burn Pattern Certification, Arson Evidence Collection and Processing, Legal Issues for the Fire/Arson Investigator, Documentation of the Fire/Crime Scene (photography, videography and sketching), Case File Preparation (Criminal and Civil), Arson Myths.

 Detailed Class Information and Price List :

 FireFuzz Enterprises offers flexible, current fire and arson related training that fits the objectives of both public safety agencies and private/commercial industry. Training opportunities are offered in five, two and one day segments, depending on selection of training topics. The five-day course offering is structured so that the new investigator acquires the tools and skills necessary to comfortably execute an origin and cause investigation of a residential or commercial structure fire. Current, state of the art investigative techniques discussed in the class will show the student how to legally enter a fire scene, eliminate potential accidental ignition sources, determine the origin and cause and document its history while collecting forensic evidence that will be used to corroborate the crime of arson.

Each student receives a detailed fire investigation manual that will be used during classroom presentations. The manual becomes property of the student to keep as a resource after completion of the week long class. A CD Rom containing all presentations as well as glossaries, important web links, arson criminal laws and related criminal investigative information is included with the registration fee. FireFuzz Enterprises agrees to continually update class graduates on changing trends, news and information in the field of fire and arson investigation through a quarterly electronic newsletter, or as necessary depending on the urgency of the information.

Ideally, a local fire or police department, or insurance concern agrees to host the training by providing a classroom facility and certain audio-visual components. The host agency is urged to provide coffee and snacks each morning. The host agency will be given three complimentary slots in the class if registration numbers twenty students. For registration of 25 or more, five complimentary slots will be provided the host agency.
 
Registration for each attendee is $225 with all materials included. A certificate of achievement will be issued to each student upon satisfactory performance in a tested material review on day five.

The class is coordinated and instructed by Doug Ross, formerly of the Greenville, South Carolina Police Department’s Arson Unit, the South Carolina Arson Control Team and the South Carolina Law Enforcement Division’s Arson/Bomb Section. Ross is recognized as a Certified Fire Investigator as sanctioned by the International Association of Arson Investigators, St. Louis, MO. In January 2006, Ross received the prestigious Senator Strom Thurmond Law Enforcement Award of Excellence for his years of dedicated concern for the advancement of training in the area of fire and arson investigation in South Carolina.
